THE CUTEST PET CONTESTS ARE VOID WHERE PROHIBITED BY LAW

The following rules (“Rules”) apply to the monthly Cutest Pet Contest (“Contest”) and The Cutest Pet Of The Year Contest (“CPOTY”), respectively. Before submitting any photos and entering the “Contest”, please be sure to read the “Rules”. By participating in “Contest” or the “CPOTY”, all “Contestants” (the pet owners) agree to these “Rules” in their entirety which shall be final and binding in all respects.

Users should read our Terms Of Use and Privacy Policy along with the following “Rules” prior to entering “Contest”.

ENTERING THE CONTEST

Each monthly “Contest” begins at (12:00:00am Pacific Time) on the first day of each calendar month and ends at (11:59:59pm Pacific Time) on the final day of each calendar month, provided the minimum 50 contestants threshold is met.
Pets entered into the “Contest” during any given calendar month are eligible to win that given month’s “Contest” regardless of the day of month that the photos are submitted, provided the minimum 50 contestants threshold is met.
There is no fee to enter any of the “Contests”. No Purchase is necessary to enter any of the “Contests”.
By entering any of the monthly “Contests”, Users (“Contestants”) are automatically entered into and eligible to win the “CPOTY” contest without having to re-register or re-enter.
Each “Pet Contestant” must be a living animal, living pet in order to “ENTER” the “CONTEST”. We cannot allow people to enter said “Contest” with pets who are deceased and no longer with us. We understand that we miss and cherish the memories of our pets that have passed.
Each person is allowed to create one user account only. You cannot create multiple user accounts. If any person is found to have more than 1 User account and they are Voting with both of those accounts that is considered cheating and will result in immediate termination and cancellation of all accounts.
Once a “Contestant” wins 1st Place in The Cutest Pet “Contest” they will be featured on the Winner’s page for that month. Additionally, each of the 3 Runners-Up for that month will be listed on that month’s Winner’s page. Furthermore, once a Contestant wins 1st Place, they will no longer be eligible to enter any additional Cutest Pet Of The Month contests for that calendar year. However, said winners of any of the Monthly Contests shall be automatically placed in to the “CPOTY” contest.
As one contest ends, another begins. As noted above once a contest ends at 11:59:59pm of one month, the next contest begins in the next breath at 12:00:00am Pacific Time, the first day of the next month. All Votes for each “Contestant” shall be reset to “0” (zero) votes and all Contestants begin on equal footing.

PHOTO SUBMISSION

Any person(s) submitting a photo or photos to “Contest”, must be the official owner of the pet “Contestant”.
The person submitting a photo for the purpose of entering “Contest”, must be a registered user of the site and must be at least 18 years of age at the time of Entry into said “Contest”.
Any person(s) submitting a photo or photos on behalf of a “Contestant” shall a) have the legal authority to do so, b) be the photographer of any and all such photos submitted, c) and/or possess written permission and/or a Photo Release indicating such permission to use, re-use or transmit said photo(s) into “Contest”.
Only one entry per pet is permitted into the monthly Cutest Pet “Contest”. If we find multiple entries of the same pet, we’ll delete the newest entries and keep only the original entry. In the event that a second or multiple entries are made for the same pet and votes are made for each pet, we will not add or combine the votes from multiple entries. If you’re not sure if your entry was submitted correctly, first check the Contestants listing directory, and do not click the Submit Entry button more than once, as that will in fact create an additional entry and may end up in votes for your pet being divided between multiple listings.
Each “Contestant” may submit as many pets as they wish, but only one entry per pet.
Each “Contestant” may submit up to 4 photos of their pet.
All Photos submitted must be high-quality. No grainy or blurry photos shall be accepted.
Photos containing political messages or advertising are not permitted.
The “Company” reserves the right to reject any photos submitted.
Acceptable file types of photos are .jpg, jpeg, .png, or .gif
Maximum file size allowed for each photo is 3mb
Recommended Photo size should be at least 650 px wide by at least 500 px tall, however the preferred size would be 800 x 1200 or 800 x 650 – but do not submit thumbnail images that are difficult to view
Cut outs or photos of the pet cropped out of a photo are not acceptable.
By submitting photos for entry into the “Contest”, you hereby grant “Promoter” the irrevocable right to use, re-use, publish or re-publish said photos throughout TheCutestPet.com Website, and in “Promoter’s” advertising campaigns and promotion materials of the “Contest” including, but not limited to the “Company’s” social media accounts of Twitter, Instagram and Facebook, as well as in emails.
As “Company” allows for users to comment on a “Contestants” page, abusive language in any comments will not be tolerated. Any acts of abusive language, threats of violence, racist comments or hateful speech will result in immediate termination of user’s account and blocking from site. If such act is committed by a “Contestant”, then such “Contestant” shall be disqualified from the “Contest” and be banned from the site indefinitely.
All photos submitted to “Contestant’s” page shall only contain said Pet. Additional persons may appear in photos submitted to the Special Category Contests however.
Each photo submitted must contain the Pet’s face.
If any illegal content is posted on the site, your account will be deleted. We reserve the right to forward such material to the authorities. This includes, but is not limited to animal abuse.
No refunds will be granted to any persons violating any rules of “Contest” or “Site”.
The “Company” reserves the right to reject any “Contestant” entry or any photo submitted for “Contest” or any section of “Site”.
“Company” reserves the right to refuse or reject any images submitted to “Contest” for any reason it deems necessary to protect the integrity and quality of “Contest” or in accordance with law.

ANNOUNCEMENT OF MONTHLY WINNERS

At exactly 12:00:00am Pacific Time, the Winner will be determined automatically by our “Contest” system as tabulated from our database and the 1st Place Winner along with the top 3 runners-up will be listed on the Winners page at that time.
Additionally, the winners will be contacted the following business day via email, sent to the email address submitted by “Contestant” at time of account registration. At that time a document will be sent along with a request for a copy of State Issued ID. Payment will be made to Winner within 2 business days, although most likely the same day and immediately upon receipt of requested document.
The Top 3 runners up will be receiving a gift or gift(s) from our Sponsor(s). Therefore we will also be contacting the qualified runners-up of their winning on the Winners page, our Home page and via email.

PRIZES AWARDED

The “Contest” is contingent upon a minimum of 50 registered, active “Contestants” entering said “Contest” each month. All Prizes will be awarded if said contingency is met. Should there not be at least 50 active “Contestants” entered into said “Contest” month and during that Contest month, then all entries and votes shall be carried over to the following month’s “Contest”.
First Place winners shall receive their $500 payment within 48 hours after the “Contest” or the “CPOTY” ends AND upon receipt of signed documents and a copy of photo ID. Both have to happen. If we don’t receive a copy of ID and signed documents within 48 hours of the “Contest” ending, then we will need to wait to submit winnings until we do receive copy of ID and signed document. IF A WINNER DOES NOT SUBMIT OUR SIGNED DOCUMENT AND PHOTO ID within 10 business days of receiving notification of winning 1st Place, except for and in the event, that said Winner is physically or otherwise incapable of communicating via phone or email that they are not able to make copies of and/or submit a signed document and state issued photo ID, then said Winner hereby forfeits their 1st place winnings.
Winners of “Financial” winnings, can choose to receive their payments via PayPal or bank wire, in which “Contest” winners shall provide necessary account information. If a Winner prefers a payment method other than PayPal or bank wire, such as Venmo, Google Pay or other, we will do our best to accommodate Winner by signing up for one of those payment processors, however, that may delay the payment being received by winner and an agreement must signed by Winner acknowledging that this was their choice.
The top 3 runners-up will be receiving a gift(s) from our Sponsor(s). These gifts on most occasions will be tangible goods, as opposed to electronic gift card, which will require the shipment of gift(s). In such cases, we will need to collect the mailing address for which each runner-up wishes to have their gift(s) sent. The delivery method in which our Sponsor(s) choose to provide such gift(s) is solely at the discretion of said Sponsor. We will provide, via email, the name and mailing address to Sponsor(s) as provided to us by Winner upon receipt from Winner.
Active “Contestants” shall be defined as at least 50 “Contestants” with at least 31 votes (an average of 1 Vote per day) at the end of that Contest month, except in the event that the current Contest month has less than 31 days, in which case a Contestant must have at least 1 Vote for each of the days that exists in that Current month, by the end of said Contest month.”

THE END OF ONE, THE BEGINNING OF ANOTHER

All of our contests are void where prohibited by law. Each contestant assumes the total responsibility of understanding any and all local, state and federal laws, as well as international laws, with regards to photo contests as each state or municipality may have specific “Contest” laws. The “Company” accepts no responsibility for making such legal interpretations as to whether or not our “Contest” is allowed by law in any potential “Contestant’s” respective jurisdiction.

WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

Each “Contestant” in The Cutest Pet “Contest” upon entering “Contest” AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS the “Company”, its “Promoter” and “Sponsors” of “Contest” from and against any and all liability, including but not limited to claims asserted, demands, causes of action, costs, expenses, losses, attorney fees, injuries, or payments for injury to any person or property, including injury to the Releasing Parties caused or claimed to be caused by the acts or omissions of “Contestant”, the “Company” or the Sponsors arising out of, related to, or in any way connected with the “Contest”. Also covered is liability arising from, connected with, caused by, or claimed to be caused by, the active or passive negligent acts or omissions of the Sponsors that may be in combination with the active or passive negligent acts or omissions of the Releasing Parties or any third party. The duty to defend, indemnify, protect and hold harmless shall not include any claims or liabilities arising from the sole negligence or willful misconduct of the “Company”.

FORCE MAJEURE “Company” shall not be liable for any delay or failure to perform an obligation to the extent that the delay or failure is caused by an occurrence beyond the party’s reasonable control. “Contestant” acknowledges that the operation of the Internet is beyond the other party’s reasonable control, and the “Company” as well as its “Promoter” shall not be held liable for a delay or failure caused by an interruption or failure of telecommunication or digital transmission links, Internet slow-downs or failures, or other such transmission failure.

The “Company” reserves the right to add, edit or modify the “Contest” “Rules”, whether in part or in their entirety, in writing at least 15 days prior to any “Rules” change, as it deems necessary to operate a safe, fun, and fair photo contest.
